City of Munford - Board of Mayor and Aldermen - Regular monthly meeting - Municipal building

Present: Mayor Dwayne Cole; Aldermen Ray Deneka, Sue Arthur, Bill Lloyd, Jack
Foraker, Johnny Crigger, Terry Colin
Others Present: See list attached.
Public hearing - Mayor Cole called a public hearing for citizen input on the following
items:
1. 2002-2003 Budgets and Property Tax rate ($0.51) - No questions or comments.
2. Weed Ordinance - No questions or comments.
3. Yard Sale Ordinance - No questions or comments.
4. Beer Ordinance - The first person to speak was Rev. Jim Laymon, 170 Beaver.
He is the pastor of Munford Assembly of God Church. He stated that in visiting
with newcomers in Munford, one of the reasons people move here is to get away
from the crime that is in the Memphis/Shelby County area. They also like the
uniqueness of our area because of our community family and Christian values. He
is afraid that allowing alcohol to be served in restaurants will lend itself to
problems with law enforcement, DUI, and such problems that he deals with as a
pastor. He also stated that alcohol is a gateway drug that destroys the family unit.
John Fite, 866 Beaver, believes serving beer in restaurants is detrimental to our
community. He stated that some of the deaths we have had in our city and
surrounding areas were alcohol related. He also said that should he, unknowingly,
go to a restaurant that served alcohol, he would be willing to drive sixty miles to
eat at an establishment that did not serve alcohol.
Rev. Mike Gibson, pastor of Munford Presbyterian Church spoke against the
proposed beer ordinance. He stated that one person out of ten in our culture have
an alcohol problem. One of the reasons people move to our city is because of our
values and quality of life. The money that the city will receive from beer sales in
restaurants is not worth it.
Laurenda Barger, 309 West Main, spoke concerning the litter she contends with
by people who throw their empty containers in her yard.
Paul Paschall, 35 N. Gretna Green, stated that people who want to drink will
drink. He wanted us to look at the revenue side stating that the city should have
revenue other than property tax and sales tax.

Gary Fodor, 154 S Aberdeen, agreed with Mr. Paschall. He urged everyone to read the
proposed ordinance.
Mayor Cole closed the public hearing at 7:20 p.m. and called the regular monthly meeting
to order. Rev Mike Gibson gave the invocation and we said the pledge to the
flag. The minutes of July 22, 2002 and August 6, 2002 were approved as stated.
Public forum:
Laurenda Barger requested the city do something concerning drainage on West Main.
She stated that the culverts are clogged and during a rain, the water from the street goes in
her yard and under her house. Mayor Cole requested Public Works Superintendent, Lynn
Hughey look into this. Mrs. Barger also requested speed limit signs in the "S" curve in
this area of West Main or some type of warning sign to slow traffic.
Gary Fodor pointed out a vacant lot in the vicinity of Park and Reeder Streets. There are
no barriers and when it rains, the dirt washes and covers the sidewalk and street.
Mr. Paschall requested that trucks owned by TDOT and also private owners hauling
asphalt, gravel, etc. on McLaughlin Drive, be stopped for speeding or raise the speed
limit.

OLD BUSINESS and Monthly Departmental Reports:
Classification of permitted uses - Mayor Cole, City Manager Neal Hunter, Code
Enforcement Officer O. P. Timbs, Alderman Sue Arthur and Alderman Terry Colin will
serve as a committee with the Planning Commission. This committee will review and
recommend an ordinance for reclassification of permitted uses.
Ordinance _2002-08-01__ An ordinance establishing a code of conduct for participants
and spectators using City of Munford recreation facilities or services. There was a
motion by Alderman Colin, seconded by Alderman Deneka to adopt Ordinance
2002-08-01 on the second and final reading. Motion carried.
Ordinance __2002-08-02__ An ordinance to add Title 9, Business, Peddlers, Solicitors,
Etc., Chapter 7 of the Munford Municipal Code for the City of Munford, Tennessee, to
add Sections 9-701 through 9-712 allowing Yard Sales. There was a motion by
Alderman Crigger, seconded by Alderman Lloyd to adopt Ordinance 2002-08-02 on the
second and final reading. Motion carried.

Ordinance ____________ An ordinance Title 13, Chapter 1, Section 13-104 of the City
of Munford Municipal Code pertaining to weeds/grass, amend by deleting the section in
its entirety and by substituting the following. There was a motion by Alderman Crigger,
seconded by Alderman Colin to rescind motion made on August 6, 2002. Motion carried.

Public Works - Sewer Step System - Public Works Superintendent Lynn Hughey
announced that the construction has been completed. The final inspection was on August
22, 2002. There is a list of items to be addressed, but Mr. Hughey feels the contractor is
doing his best in each case. Alderman Crigger commended the Public Works Department
for an excellent job.
Drainage Issues - Mayor Cole, Neal Hunter, Lynn Hughey and the Public Works
Committee will identify areas, prioritize and get cost estimates.
Public Safety - None.
General Welfare - None.
Parks and Recreation - None.
NEW BUSINESS
Called meeting - A called meeting of the Board of Mayor and Aldermen is scheduled for
Tuesday, September 3, 2002. The purpose is to consider final passage of the proposed
2002-2003 Budgets and 2002 Property Tax Rate and any other business pertinent to the
city.
Ordinance _______________ An ordinance to amend Title 8, Chapter 2 of the Munford
Municipal Code, relative to beer permits. There was a motion by Alderman Crigger,
seconded by Alderman Foraker to adopt Ordinance _______________ on the first
reading. Mayor Cole requested a roll call vote: Alderman Crigger, yes; Alderman
Foraker, yes; Alderman Colin, no; Alderman Deneka, yes; Alderman Arthur, no;
Alderman Lloyd, yes. Motion carried.
Mayor Cole stated, "Make no mistake, this was not something that I was pushing. I am
personally against it." The second and final reading will be included in the
September 3, 2002 called meeting.

Ordinance_______________ An ordinance amending Title 13, Property Maintenance
Regulations, Chapter 1, Section 13-107 and 13-108 to the City of Munford Municipal
Code. There was a motion by Alderman Foraker, seconded by Alderman Colin to adopt
Ordinance _______________ on the first and final reading. Motion carried.
Public Works - None.
Public Safety - Police - (1) Patrolman Mark Daugherty attended a course on Basic
Clandestine Laboratory Safety and Site Training July 29-August 1, 2002. This was a 40
hour course and goes toward his in-service training and is P.O.S.T. approved. (2) MPD
participated in the Back To School Fair at Munford Assembly of God Church on August
10, 2002.
Public Safety - Fire - (1) Alderman Foraker reported that the Fire Committee met on
August 12, 2002 with Atoka Alderman Bret Pickard. Plans are to hire two more full time
firefighters. This will enable the department to man the Atoka Fire Station at night as is
now being done in Munford. Alderman Foraker expressed his appreciation to the Board
for their support and Fire Chief Jay Bonson for his leadership. (2) Incident report

General Welfare - None.
Parks & Recreation - Report attached.
Financial Report - There was a motion by Alderman Foraker, seconded by Alderman
Colin to approve financial reports. (See attached.) Motion carried.
Checks over $10,000.00 - There was a motion by Alderman Foraker, seconded by
Alderman Lloyd to approve checks over $10,000.00. (List attached.) Motion carried.
